EVENT RELEASE AND INDEMNITY AGREEMENT In consideration of your
acceptance of this event entry, I, for myself, my heirs, executors,
administrators and assigns, forever release and discharge Mesquite
Rotary Club, City of Mesquite, Town of Sunnyvale,City of Dallas,
City of Seagoville, City of Balch Springs, County of Dallas,
County of Kaufman, and any and all participating event sponsors
and the directors, officers,employees, sponsors and agents of
such parties (the “Mesquite Rotary
Club, et al.”),from any and all liability, claims, demands
or causes of action that I may hereafter have for injuries, death,
or damage resulting from my participation in cycling or skating
activities in the 2008 Mesquite Rodeo Bike Ride. I attest and
verify that I am physically fit and sufficiently trained to participate
in this event. I further attest and verify that cycling and skating
activities are inherently dangerous and may result in injury
or death, that I assume those risks, that I assume and will pay
my own medical and emergency expenses in the event of an accident,
illness or other incapacity, regardless of whether I have authorized
such expenses. I further agree that I WILLNOTSUE OR MAKE CLAIM
AGAINST the Mesquite Rotary Club, et al. for damage or losses
sustained as a result of cycling or skating activities. I also
AGREE TO INDEMNIFYAND HOLD HARMLESS Mesquite Rotary Club, et
al. from all claims, lawsuits, judgments and costs, including
but not limited to, attorneys’fees,
to reimburse them for any expenses whatsoever incurred in connection
with any action resulting from my participation in cycling or
skating activities in the 2008 Mesquite Rodeo Bike Ride, EVEN
IF SUCH DAMAGES OR LOSSESARE CAUSED BYTHE NEGLIGENCE OR OTHER
FAULTOF MESQUITE ROTARYCLUB, CITYOF MESQUITE, TOWN OF SUNNYVALE,
CITYOF DALLAS, CITYOFSEAGOVILLE, CITYOF BALCH SPRINGS, COUNTYOF
DALLAS, COUNTYOFKAUFMAN, AND ANYAND ALLPARTICIPATING EVENTSPONSORS
AND THEDIRECTORS, OFFICERS, EMPLOYEES, SPONSORS AND AGENTS OF
SUCH PAR-TIES (the “Mesquite Rotary Club, et al.”).
